Terms of Use

These terms govern your use of Berkshire Financial Services LLC's website. They explain what our services do and do not include, how fees work, and what we ask of you when you use this site.

Effective October 20, 2026

Acceptance of These Terms

This website is operated by Berkshire Financial Services LLC ("Berkshire", "we", "us", or "our"). By accessing or using this site, you agree to these Terms of Use and to our Privacy Policy, which is incorporated into these terms. If you do not agree, please do not use this site.

We may update these terms from time to time. The updated effective date appears at the top of this page, and continued use of the site after a change means you accept the revised terms.

Who Our Services Are For

Berkshire provides restructuring and negotiation services for commercial debt only — for example merchant cash advances, business loans, and vendor balances — for businesses that generally carry $20,000 or more in commercial obligations. We do not handle personal or consumer debt.

Not every business or obligation will qualify. A free assessment tells you whether your situation is one we can work with; it does not create an obligation for you to enroll, and it is not an offer of credit.

What We Are Not

Berkshire is not a lender and not a law firm. We do not make loans, we do not assume or pay your debts, we do not act as your attorney, and we do not provide legal or tax advice to you. We do not offer debt consolidation services.

Information on this site is general in nature. It is not a substitute for advice from a qualified attorney or tax professional about your specific circumstances, and nothing on this site creates an attorney-client relationship.

Fees and Enrollment

There are no upfront fees. Our fees are disclosed in writing before enrollment and are included in your restructured payment. You are not enrolled in any program until you sign an agreement with us, and no page, form, or message on this site enrolls you or commits you to anything.

No Guarantee of Results

Restructuring and negotiation outcomes depend on your creditors, your obligations, and your financial situation. Estimates we provide are based on historical outcomes, and individual results will vary. We cannot guarantee a specific reduction amount or percentage, that you will become debt-free, or that any creditor will agree to a settlement.

Restructuring or settling business debt can have tax, credit, and legal consequences. Forgiven debt may be treated as taxable income, and creditors may continue collection activity or legal action while negotiations are under way. Where this site shows testimonials or representative engagements, they reflect specific situations and are not a promise of similar results.

Your Responsibilities

When you contact us or complete an assessment, you agree to provide accurate, complete, and current information about your business and its obligations, and to tell us promptly when that information changes. You confirm that you are authorized to act for the business you represent and that the information you submit is yours to share.

You remain responsible for your obligations to your creditors until those obligations are resolved. We are not responsible for outcomes that follow from information you gave us that turns out to be inaccurate or incomplete.

We give you a limited, revocable permission to use this site for lawful purposes — principally to learn about our services and to contact us. The site, including its text, design, logos, and layout, belongs to Berkshire or its licensors. You may not copy, republish, or redistribute it commercially without our written permission.

Communications and Call Recording

When you call, submit a form, or request an assessment, you ask us to contact you about your inquiry. We may reach you by phone, email, or text at the details you provide, including by automated or prerecorded means. Message and data rates may apply. All incoming and outgoing calls may be recorded for quality, training, and monitoring purposes. You may ask us to stop contacting you at any time by emailing info@berkshirefs.com.
